A Hawaii 45 Day Notice to Quit is used to terminate a month-to-month rental agreement or tenancy-at-will without alleging any tenant wrongdoing. This notice informs the tenant that the landlord has elected to end the rental relationship and requires the tenant to vacate the property by a specified date. Hawaii law allows a tenant to move out at any time during the notice period, provided proper notice is given to the landlord and rent is prorated accordingly.

This notice does not require the landlord to state a reason for termination, but it must comply with Hawaii’s statutory advance notice requirement.

What Does Hawaii Law Say?

(a) When the tenancy is month-to-month, the landlord may terminate the rental agreement by notifying the tenant, in writing, at least forty-five days in advance of the anticipated termination. When the landlord provides notification of termination, the tenant may vacate at any time within the last forty-five days of the period between the notification and the termination date, but the tenant shall notify the landlord of the date the tenant will vacate the dwelling unit and shall pay a prorated rent for that period of occupation.
